Terms of Service

Effective Date: August 31, 2026

These Terms of Service ("Terms") govern your access to and use of Paddock. By purchasing, accessing, or using Paddock, you agree to these Terms.

1. Paddock Services

Paddock provides software and automation services designed for auto detailing businesses.

Depending on a customer's configuration, Paddock may assist with lead response, customer communication, quoting, follow-up, missed-call response, booking communication, appointment reminders, cancellation and rescheduling workflows, review requests, customer reactivation, and related business processes.

Specific functionality may depend on the customer's configuration and third-party services.

2. Setup and Configuration

Paddock may be configured using information supplied by the customer, including:

  • Services and pricing
  • Vehicle categories
  • Business hours
  • Appointment durations
  • Booking rules and availability
  • Policies and frequently asked questions
  • Customer communication preferences
  • Other information necessary to configure supported Paddock functionality

Customers are responsible for providing accurate and current information.

Paddock is not responsible for incorrect quotes, scheduling information, communications, or other outputs resulting from inaccurate, incomplete, or outdated information supplied by the customer.

3. Configuration and Custom Development

Standard Paddock setup may include configuring supported Paddock functionality around the customer's services, pricing, vehicle categories, booking rules, messaging, policies, and supported business systems.

Unless separately agreed in writing, a Paddock subscription does not include custom software development, new integrations, websites, advertising services, custom CRM development, payment systems, or entirely new workflows or features.

Requests outside standard configuration may require additional fees or a separate agreement.

4. Subscription and Fees

Customers agree to pay the fees presented at purchase or otherwise agreed to in writing.

Unless otherwise specified, Paddock subscriptions are billed monthly.

Applicable taxes may be added where required.

Pricing, promotional offers, setup fees, and other charges may vary based on the plan or offer selected by the customer.

5. Founding Beta

Customers accepted into the Paddock Founding Beta may receive special pricing and waived setup fees.

The current Founding Beta offer is:

  • $300 per month
  • $1,000 standard setup fee waived

Founding Beta customers may be asked to provide detailed feedback to help improve Paddock.

Providing a positive review, testimonial, or endorsement is not required as a condition of Founding Beta pricing.

Paddock will obtain appropriate permission before publicly using identifiable customer testimonials or results.

6. Cancellation

Unless separately agreed in writing, Paddock does not require a long-term commitment.

Customers may cancel their Paddock subscription according to the cancellation process provided by Paddock.

Cancellation prevents future recurring subscription charges after the applicable paid billing period.

Fees already paid are non-refundable except where required by law or expressly agreed otherwise.

7. No Guarantee of Business Results

Paddock is designed to help businesses manage customer opportunities and repetitive customer communication more efficiently.

Paddock does not guarantee any specific number of leads, bookings, customers, reviews, revenue, conversion rate, or other business result.

Results depend on factors outside Paddock's control, including lead volume and quality, pricing, services, availability, market conditions, customer behavior, business reputation, and the customer's own operations.

8. Automated and AI-Generated Communications

Certain Paddock functions use automated systems and artificial intelligence.

Automated systems can make mistakes and may occasionally produce inaccurate, unexpected, delayed, or inappropriate outputs.

Customers are responsible for reviewing their Paddock configuration and promptly notifying Paddock of inaccurate or unexpected behavior.

Paddock does not represent or guarantee that every automated communication or action will be error-free.

9. Customer Responsibilities

Customers agree to:

  • Provide accurate business, pricing, service, and scheduling information
  • Keep their business information reasonably current
  • Use Paddock only for lawful purposes
  • Obtain any permissions and consent required for customer communications
  • Honor customer opt-outs
  • Avoid unlawful, deceptive, abusive, or unsolicited communications
  • Comply with applicable privacy, telecommunications, advertising, and consumer-protection requirements
  • Maintain appropriate security for connected accounts
  • Review situations requiring human judgment when appropriate

10. SMS and Messaging

Customers using Paddock for SMS communications are responsible for ensuring that recipients have provided any consent required for the communications being sent.

Recipients must be permitted to withdraw consent where required.

Customers may not use Paddock to circumvent opt-outs, messaging restrictions, carrier requirements, or applicable consent requirements.

Where applicable, message and data rates may apply.

Message frequency may vary based on customer interactions, appointments, follow-up activity, and configured workflows.

Recipients may reply STOP to opt out and HELP for assistance where supported.

Carriers are not liable for delayed or undelivered messages.

11. Third-Party Services

Paddock may depend on third-party platforms and services, including communications providers, scheduling systems, artificial intelligence providers, workflow infrastructure, email providers, hosting providers, and other integrations.

Third-party services may experience downtime, delays, API changes, restrictions, outages, or other failures outside Paddock's control.

Paddock is not responsible for the independent availability, acts, omissions, or operation of third-party services.

12. Service Availability and Changes

Paddock aims to provide reliable service but does not guarantee uninterrupted or error-free operation.

Paddock may modify, improve, replace, add, or discontinue features as the product evolves.

Paddock may temporarily suspend functionality when reasonably necessary for maintenance, security, legal compliance, or protection of Paddock and its users.

13. Customer Data

As between Paddock and the customer, the customer retains its rights in customer data provided to or processed through Paddock.

The customer grants Paddock the rights reasonably necessary to process customer data for the purpose of providing, maintaining, securing, supporting, and improving Paddock.

Personal information will be handled in accordance with the Paddock Privacy Policy.

14. Intellectual Property

Paddock and its software, workflows, systems, designs, documentation, branding, and other proprietary materials remain the property of Paddock and its licensors.

Purchasing or subscribing to Paddock provides the customer with a limited right to use the service while the customer's subscription remains active.

It does not transfer ownership of Paddock's underlying software, systems, workflows, branding, or intellectual property.

15. Feedback and Product Suggestions

Customers may provide ideas, recommendations, feature requests, and other feedback.

Paddock may use feedback to develop and improve its products and services without obligation to implement any particular suggestion or compensate the person providing it.

16. Suspension and Termination

Paddock may suspend or terminate access when reasonably necessary because of:

  • Nonpayment
  • Fraud or abuse
  • Illegal activity
  • Messaging-policy violations
  • Security threats
  • Material violation of these Terms
  • Conduct that creates substantial risk to Paddock, its providers, customers, or third parties

Where reasonably practicable, Paddock will attempt to provide notice before suspension or termination.

17. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PADDOCK IS PROVIDED "AS IS" AND "AS AVAILABLE."

PADDOCK DISCLAIMS WARRANTIES NOT EXPRESSLY PROVIDED IN THESE TERMS, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

18. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PADDOCK WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST BUSINESS OPPORTUNITIES, LOSS OF DATA, OR BUSINESS INTERRUPTION ARISING FROM OR RELATED TO PADDOCK.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PADDOCK'S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT THE CUSTOMER PAID TO PADDOCK DURING THE THREE MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

19. Indemnification

To the extent permitted by law, customers agree to indemnify and hold harmless Paddock and the individuals involved in operating Paddock from third-party claims arising from the customer's unlawful use of Paddock, violation of messaging or consent requirements, inaccurate information supplied by the customer, or material violation of these Terms.

20. Governing Law

These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law principles.

Any dispute relating to these Terms or Paddock will be handled in an appropriate court located in Utah unless applicable law requires otherwise or the parties separately agree to another dispute-resolution process.

21. Changes to These Terms

Paddock may update these Terms as the service evolves or as requirements change.

Updated Terms will be posted on this page with a revised effective date.

Where required, reasonable notice of material changes will be provided.
